What the PACT Act is

The Prevent All Cigarette Trafficking Act is federal law governing the interstate sale and shipment of tobacco products. Its scope was expanded in 2021 to cover electronic nicotine delivery systems, and the practical effect for this industry has been that a range of nicotine products now carry registration, reporting and delivery requirements that previously applied mainly to cigarettes and smokeless tobacco.

Why it matters to you as a buyer

The obligations sit with the business doing the selling and shipping. If you buy from us and resell within your own state to walk-in retail customers, your position is different from a business shipping product across state lines. The moment you ship interstate, a set of registration and monthly reporting duties can attach to you.

The general shape of the obligations

• Registration. Businesses selling covered products interstate generally must register with the federal government and with the tobacco tax administrator of any state they ship into.
• Monthly reporting. Reports of shipments into a state, typically listing quantities and recipients, are generally filed with that state.
• Delivery requirements. There are rules around how covered products may be carried and delivered, including age verification at delivery.
• State excise tax. Separate from the PACT Act, and separately your responsibility, with treatment varying widely by state.
